Kitchen Liability Waiver Agreement

Purpose
The purpose of this Waiver is to outline and acknowledge the risks associated with the use of the Commercial Kitchen located at 405 1st Street East, Cochrane, Alberta, T4C 1Y7 and to release the Frank Wills Memorial Society from certain liabilities, including those arising from the activation of the fire suppression system/pull station.
Assumption of Risk
The user acknowledges that the use of kitchen facilities involves inherent risks, including but not limited to burns, cuts, slips, falls, smoke inhalation, and potential exposure to fire hazards. The user voluntarily assumes all such risks associated with kitchen use.
Pull Station Activation
The user understands that the kitchen is equipped with a fire suppression system and pull station for emergency use. The user agrees:
- To activate the pull station only in the event of a genuine emergency that threatens safety or property.
- To follow all posted instructions and facility protocols regarding fire suppression system, safety and evacuation.
- To immediately notify Facility staff upon activation of the fire suppression system / pull station.
- To refrain from tampering with or unnecessarily activating the pull station, understanding that false alarms may result in emergency response charges and other liabilities.
The user further understands and agrees that any costs incurred by the Facility because of unnecessary activation of the fire suppression system, including emergency response charges, cleaning, and refill of safety equipment, may be deducted from the user’s deposit. Additional charges may also apply if these costs exceed the deposit amount.
Waiver and Release of Liability
In consideration for being permitted to use the kitchen facilities, the user hereby releases, waives, and discharges the Facility, its directors, officers, employees, and agents from any and all claims, liabilities, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or expense that may be sustained by the user while using the kitchen, including any incident involving the fire suppression system/pull station activation, except where such loss or injury is caused by gross negligence or wilful misconduct of the Frank Wills Memorial Society.
Indemnification
The user agrees to indemnify and hold harmless the Frank Wills Memorial Society from any claims, damages, losses, or expenses (including legal fees) arising out of the user’s actions, including improper use or activation of the fire suppression system/pull station.
Acknowledgement and Understanding
The user certifies that they have read and understood this Waiver, and that all questions regarding the risks and responsibilities have been answered to their satisfaction. The user acknowledges that this Waiver is binding upon themselves, their heirs, executors, administrators, and assigns.
